Who Should Attend
This 3-day course covers the ASTM Environmental Site Assessment Standard Practices for the Phase I Site Assessment (E 1527) and the Phase II Environmental Site Assessment (E 1903). You will gain an understanding of how to use the standards and how the standards affect the way you do business.

The instructors will also discuss the "Innocent Landowner Defense" under the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA), and why due diligence is necessary.

The first day of this course focuses on
ASTM E 1527. It covers the Small Business Liability Relief and Brownfields Revitalization Act. This new law has MAJOR IMPLICATIONS for the Phase I ESA practice, including:
  • Amending the criteria for "all appropriate inquiry"
  • Adding a new class of exemptions for "bona fide prospective purchasers"
  • Impacts from contiguous properties.

The second day focuses on
how to properly plan and perform Phase II investigations using ASTM E 1903 Standard Guide for Phase II Environmental Site Assessments. It covers the various approaches used in the Phase II process to generate additional information regarding the identification and nature of potential contaminants associated with RECs identified during the Phase I Processes to assist in making informed business decisions concerning commercial real estate transactions.
